Booking/Hire Terms & Conditions

1.1 We aim to provide high quality adventure experiences specialising in Bike Hire & Uplift Services. To achieve this at a reasonable cost we ask you to treat all equipment responsibly.

1.2 Bookings can only be made and fulfilled on completion of a ‘Bike Rental Agreement Form’ and/or a ‘Safety Briefing & Acceptance of Risk Form’. We reserve the right to take your Credit Card details to hold as security until the equipment is returned in the condition it was hired out in. Upon acceptance of these Terms & Conditions a binding contract is formed between us and you. We reserve the right not to accept or to fulfil a Booking.

1.3 All Bookings are subject to availability. When a Booking is made by one person on behalf of another person or people, that person confirms to us that he or she has the authority to make such a booking.

1.4 The Hire period commences on the day the equipment is collected or dispatched to you the customer and continues until the equipment is returned to us.

Hirer’s Terms & Conditions

2.1 You are responsible for ensuring that you have the knowledge, skills and fitness to undertake the adventure activity involving the equipment you have booked. We do not accept any responsibility for your failure to complete your hire period due to lack of knowledge, skill, fitness, illness or injury. We do not accept liability for death, personal injury, loss or damage to personal effects to you the customer, nor can we accept any responsibility for delays or changes to your period of hire due to weather, strikes, war, terrorism or other causes.

2.2 You accept that adventure activities carry their own risks and you have made your booking on the basis that you undertake the hire at your own risk. You understand and accept that we always advise the wearing of the correct protective equipment (body armour, goggles, and gloves) when undertaking the adventure activity, and that helmets are a mandatory requirement.

2.3 You will always participate responsibly, at all times, when undertaking the adventure activity and when making use of the services provided. You will not hold us responsible for any loss, damage or injury including death to persons or property regarding the use of the equipment hired or regarding the use of our Uplift Service. You accept responsibility to Indemnify us against any claim, interest, demand, or expense in respect of such injury or damage.

2.4 Mountain biking can be a hazardous activity.  There is a risk of injury and death when undertaking such activities. We recommend that you take out sufficient insurance for personal liability and injury because of the high degree of risk associated with mountain biking activities.  You should contact a reputable insurer or broker.

2.5 You are responsible for all equipment hired or loaned and it is your responsibility to keep these items safe from damage, loss or theft, use it in a proper manner and not subject it to any misuse or unfair wear and tear.

2.6 Any damage caused due to crash or neglect is the Customer’s responsibility and will be charged for.

2.7 You will notify us immediately of any loss, damage or theft to the hired equipment however caused. You will be responsible for paying us the reasonable costs of repair or replacement for any such loss, damage or theft.

2.8 You will not offer for sale, sell, dispose, mortgage, lend, pledge or otherwise part with possession of the hired equipment.

2.9 Our staff are usually available by phone or email to help out with any problems during the hire period; However, it is the customer’s responsibility to assemble, set up and keep a check on the equipment they have hired. Whilst we will always do it’s best to have staff available during the hire period this cannot be guaranteed.

2.10 You are responsible for checking the bike and any protection equipment for any damage after each run on a trail, and especially after a crash no matter how minor. The Mountain Bike and Equipment Checklist can be utilised for these inspections.

Payment Terms

3.1 Payments are collected on booking the equipment. Our cancellation policy is as follows:

Up 14 days before the booking date: 0% of the booking will be charged.

Up to 2 days before the booking date: 50% of the total booking cost will be charged.

Within 48 hours of the booking date: 100% of the total booking cost will be charged.

We will consider individual cases in extraordinary circumstances.

3.2 In consideration of our arranging and fulfilling your hire in accordance with these terms and conditions you will pay us the total price for your period of hire set out in the hire agreement form in advance of the hire commencing.

3.3 Our prices include VAT where VAT is required. However, if the rate of VAT changes between the date the Confirmation Order is dated (the “Start Date”) and the date of delivery of the Services (the “Delivery Date”), we will adjust the VAT you pay, unless you have already paid for the Services in full before the change in the rate of VAT takes effect.

3.4 Late return of equipment will be charged at twice the published daily hire rate for each day/ part day that the equipment is returned late.

3.5 A Credit Card will be required at the commencement of any hire period, but this may extend to a deposit to the value of the equipment by credit or debit card payment or other surety as deemed sufficient by us depending on our assessment of the risk and the value of the equipment. If a deposit is taken it will be returned at the end of the hire period provided that;

Any equipment hired or used are returned in an undamaged condition to us.

Any equipment hired or used are returned within the arranged hire period at an arranged time and place to us.

3.6 If the terms set out in 3.4 (above) are not complied with, we reserve the right to charge reasonable charges until such time when the equipment concerned has been returned to us. In the case of equipment left or returned damaged, you are responsible for any costs incurred and sustained in replacing or repairing (whichever the cheaper) the items concerned to a condition equivalent to that prior to the hire.

3.7 In all cases normal wear and tear as defined by the products manufacturer or supplier is accepted and allowed and is included in any hire price.

3.8 In all cases, the security/ damage deposit can be used as a deposit against the costs or charges mentioned herein.

Personal Safety

4.1 It is the user’s responsibility for their own safety. Adventure activities involve personal risk and you must participate responsibly.

4.2 Injury(s) and/or death associated with adventure activities may result from weather, excessive speed, drowning, collision with inanimate objects or other persons, user inexperience, error, or abuse of equipment.

4.3 Beginners/novice participants should use the equipment under the supervision of an experienced participant where possible.

4.4 You must not participate in any of the activities we facilitate or the services we provide under the influence of alcohol, strong medication, other drugs or fatigue.

Limitation of Liability

5.1 Subject to Clause 5.2, we shall not be under any liability (whether or not damage or loss is direct, indirect, consequential, foreseeable, known or otherwise) for loss you suffer in connection with this Contract.

5.2 Nothing in the Contract limits in any way our liability for:

5.2.1 death or personal injury caused by our negligence;

5.2.2 fraud or fraudulent misrepresentation;

5.2.3 any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982;

5.2.4 losses for which it is prohibited by section 7 of the Consumer Protection Act 1987 to limit liability; or

5.2.5 any other matter for which it would be illegal or unlawful for us to exclude or attempt to exclude our liability.

5.3 all participants must sign a Safety Brief & Acceptance of Risk statement (along with a Bike Rental Agreement as previously noted in clause 1.2) prior to participation of the uplift service or rental of bikes & protection equipment. This acceptance of risk will cover without exception;

5.3.1 You understand that it is a mandatory requirement for me to always wear a helmet and that it is highly recommended to wear a full-face helmet, body armour, goggles and gloves.

5.3.2 You agree to check the bike and any protection equipment as per the Bike & Equipment Checklist at the store BEFORE setting out on any ride. You will also complete check the bike and any protection equipment for any damage after each run on a trail, and especially after a crash no matter how minor.

5.3.3 You agree that I will read and always follow the Responsibility Code.

5.3.4 You agree to abide by the Uplift Safety Rules and Safety Code.

5.3.5 You understand that Mountain Biking is dangerous and includes substantial obstacles and technical features, which can be physically testing. You accept that there is a risk of injury and death when undertaking such activities, and that I am taking part in this activity at my own risk and will participate responsibly.

5.3.6 In the unlikely event of an accident, or loss or damage to my personal effects, you acknowledge that the company (Campbase Adventures Ltd) and any associated parties will not be liable for any direct or indirect loss, damage or injury arising from or in connection with the Activities (except for death or Personal Injury caused by the Company’s negligence).

5.3.7 You certify that to the best of my knowledge you do not have a medical condition which could result in injury to yourself or to others.

5.3.8 You agree to all Terms and Conditions as displayed on Campbase Adventures Ltd website and as provided to me at the time of booking.

5.4 We shall have no liability to you if we are unable to fulfil a booking due to an event of Force Majeure. In the event of us being unable to fulfil your booking our liability to you shall not exceed to the agreed cost of the hire.

5.5 Except where expressly permitted under the Data Protection Act 1998, we will only use your personal details in connection with your booking arrangements, unless you agree otherwise. We will keep your personal details secure in accordance with our obligations under the Date Protection Act 1998.

Behaviour and Responsibilities

6.1 Guests must always have a valid lift ticket for the uplift service on their person. Guests may encounter ticket checking at any point on the bus. All participants are expected to behave decently and in such a manner as to not harm the reputation of Campbase Adventures Ltd or injure other uplift participants.

6.2 Participants must follow the Mountain Bikers Responsibility Code to ensure you and others have a safe and fun ride.

6.2.1 Campbase Adventures Ltd reserve the right to ask customers/clients to return bikes immediately with no refund or remove uplift tickets without refund from clients for breaches of the mountain biker’s responsibility code.

6.2.2 Always carry a mobile phone during your visit and ensure the charge is sufficient to last the entire period that you are renting equipment from us. If in need of assistance contact 07435769249.

6.2.3 Avoid riding independently/alone where possible to maximise safety. Besides, it is also more fun riding with others.

6.2.4 Ride within your capabilities and keep your bike under control. It is your responsibility to avoid crashing into other riders and objects around you! Remember you are liable to pay in full the cost of any loss or damage of the bike/equipment.

6.2.5 Respect other riders and be aware of their varying skill level/knowledge.

6.2.6 Follow the one-way system on trails. Always look uphill when entering a trail/starting downhill to give way to other riders coming down.

6.2.7 Pull off the trail in a safe place if you need to stop or take a break for any reason. Do not stop in the middle of the trail to avoid damage to equipment or injury to yourself and others.

6.2.8 Respect other trail users and exercise caution when the trails cross other trails or walking routes.

6.2.9 Trail conditions change with the seasons and the weather; mountain biking is an all-weather sport but respect the added challenge and risk that rain, ice, dust and wind can pose to you.

6.2.10 Stick to the official marked Mountain Bike Trails as signposted and obey all signs and warnings.

6.2.11 Do not push or ride up downhill trails.

6.2.12 Respect the environment and area that we provide the services within – follow the ‘leave no trace’ principles.

6.2.13 Do not ride if you are under the influence of drugs or alcohol.

6.2.14 Riders 16 years of age and under must be always accompanied by a legal guardian (over 18).

6.2.15 Listen and follow instructions when making use of the uplift service – safety first!

6.3 Campbase Adventures has a zero tolerance policy to illegal substances, if you appear to be under the influence of alcohol or drugs, you will not be permitted to ride.

6.4 Every rider must sign a disclaimer prior to taking part in the uplift. Those aged under 18 must have signed consent from a parent or guardian aged over 18.  Those under 17 must be accompanied by parent or guardian and parent or guardian must stay on site for the duration of the uplift day.

6.5 Campbase Adventures Ltd reserves the right to remove any participant from all aspects of the uplift service or mountain bike hire if we feel a client is behaving in an unacceptable manner. The company will not be responsible for any costs the client incurs due to being removed from the service. No refund will be given if you are removed from the service due to your behaviour.

6.6 All your property is your own responsibility.

Covid-19

7.1 We have revised our way of working to accommodate the additional challenge of Coronavirus, with a focus on protecting both our staff and you our clients as required by law.

7.2 To assist us in delivering on our part, we require you to deliver on yours as per current UK Government guidance – Social Distancing when in public, Self-Isolation when necessary & Personal Hygiene (hand washing) at all times

7.3 We also require you to confirm the following – we will accept your acknowledgement of our terms as confirmation;

I confirm that within the last 14 days I, nor anyone involved in my booking have not been infected or shown symptoms of Covid-19

No one in my household or that of anyone in my booking has been infected or shown symptoms of Covid-19

No one in my household or that of anyone in my booking is in the vulnerable or extremely vulnerable categories as defined in the current UK Government advice

7.4 During the period of Covid-19 pandemic and until further notice we have input certain operating guidelines that we ask all riders to adhere to. These are as follows and not to be deviated from:

7.4.1 Reduced capacity during upload

7.4.2 Only one rider shall load trailer at a time and then load on allocated seating within the bus. Front seats of the bus are reserved for our driving teams safety.

7.4.3 Masks are obligatory during the upload in our buses, whilst waiting in line for the bus. For the safety of all riders and staff we cannot accept any Medical exemptions.

7.4.4 Physical distancing should be followed in any of our queue lines whether that be during check in or whilst waiting for a bus.

7.4.5 Please follow our one way system in place for check in.

7.4.6 Four hand sanitizing stations are provided at the entrance to all our facilities and are to be used prior to entering for check in, loading our buses, entering our cabin, or using our toilet facitlities.

7.4.7 We cannot permit eating or drinking on our buses at anytime.

7.9.8 Uplift and Mountain Bike Hire bookings can only be accepted if the person or parties making the reservation do so within UK Government restrictions and travel guidelines. Procedures are in place to check those travelling to use the uplift at each location are doings so within the parameters of the guidelines. Campbase Adventures Ltd reserve the right to refuse travel on our buses if the guidelines have been breached.

General

8.1 These terms and conditions constitute the entire agreement between us and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

8.2 Any notice required or permitted to be given by either of us to the other under these terms and conditions shall be in writing.

8.3 No failure or delay by either of us in exercising any of its rights under these terms and conditions shall be deemed to be a waiver of that right, and no waiver by either of us of any breach of these terms and conditions by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.

8.4 If any provision of these terms and conditions is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.

8.5 Except as otherwise expressly provided herein, nothing in these terms and conditions confers or purports to confer on any third party any benefit or any right to enforce any of these terms or conditions pursuant to the Contracts (Rights of Third Parties) Act 1999.

8.6 These terms and conditions shall be governed by law, and both of us hereby agree to submit to the exclusive jurisdiction of the relevant Courts.

Assignation       

9.1 You may not transfer any of your rights or obligations under these Terms to another person without our prior written consent, which we will not withhold unreasonably. We can transfer all or any of our rights and obligations under these Terms to another organisation, but this will not affect your rights under these Terms.

Interpretation

10.1 In these terms and conditions (the “Terms”) “we/us” means Campbase Adventures Ltd a company incorporated in Northern Ireland (registered number NI679252 ) and having its registered office at 89 Drumquin Road, Castlederg, BT81 7RQ. “Website” means the website www.campbaseadventures.com and “you” means the person placing the order with us for the supply of the Services. “Services” means the services provided to you by us as set out in the Booking Form and confirmed in the Booking Confirmation.

10.2 The Terms together with the Booking Confirmation constitute the entire agreement between you and us for the supply of the Services (the “Contract”).
